ETAM SWEEPSTAKES
WIN A YEAR OF LINGERIE

1- ORGANISATION

ETAM LINGERIE is a limited company registered under the laws of the Republic of France, having its headquarters at 57/59 Rue Henri Barbusse, 92110 Clichy, France (hereafter “ETAM)”, will conduct a Sweepstakes called “Win a year of Lingerie” (hereafter the “Sweepstakes”). ETAM is the sole organizer and administrator of the Sweepstakes. The Sweepstakes is neither endorsed, organized, nor administered by a third party or by Instagram. All information provided by the Entrants shall be used only by ETAM.

2- ELIGIBILITY, CONDITIONS, TIMING AND TERMS OF PARTICIPATION

The eligibility requirements to participate in the Sweepstakes are as follows:

a) Entrant must be over the age of 15;
b) have access to the Internet;
c) have a personal, valid e-mail address or telephone number; and
d) be a resident of the 50 United States or District of Colombia
NO PURCHASE IS NECESSARY TO ENTER THE SWEEPSTAKES

The following are excluded from participation in the Sweepstakes:

Any employee, consultant, agent or officer of ETAM Lingerie, its affiliates, agencies and subsidiaries, and members of their immediate family or persons living in the same household

Any Entrant under the age of 21 must have prior approval from one of his/her parents or legal representative. ETAM may request proof of such prior approval.

The odds of winning will be dependent upon the number of entries received.

Daily Sweepstakes. From March 26, 2022 to April 3, 2022, the Sweepstakes will be available on the Etam dedicated website https://etamloves.com/.
Monthly Sweepstakes. From April 4, 2022 to December 31, 2022, the Sweepstakes will be open on the ETAM American website us.etam.com.

Enter by providing your email address onto the etamloves website https://etamloves.com/ from March 26 to April 3 or the ETAM American website us.etam.com from April 4 to December 31 and opting in to receive emails from ETAM. You can opt-out at any time and you will still be entered in the Sweepstakes. Click on the icon for the “Win a year of Lingerie”. Sweepstakes and follow the on-screen entry instructions. You must fill in all required information. An Entrant may enter only once for the Sweepstakes and with only one (1) email address. Entrant’s entry into the App Sweepstakes will automatically be the entry for the Internet Sweepstakes so only one entry is required or permitted. Use of any robotic, automatic, programmed or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. Entrant may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent these rules. Any Entrant who registers under a pseudonym, alter ego, or otherwise false identity, and/or provides false information, will be automatically disqualified from participation.

3- SELECTION OF THE WINNERS AND PRIZE

ETAM will randomly draw the winners by lot. From May 16, 2022 to May 15, 2023, included, ETAM will select and announce one winner per week. The announcement will be the Monday of the following week at 10:00 Eastern Standard/Daylight Time. From May 23, 2022 to May 15, 2022, ETAM will announce one winner per week. The announcement will be made on the Monday of the following week at 10:00 Eastern Standard/Daylight Time. Potential winners will be notified by email and will have to sign and return any required Affidavit of Eligibility and Release on ETAM Lingerie’s release and authorization form, and as required by Paragraph 4, within five (5) calendar days of the date notice is sent or such other date set by ETAM. Failure to respond within the applicable time period may result in forfeiture of prize and ETAM shall have the option to award the prize to an alternate winner. The return of any prize notification or prize as undeliverable will result in disqualification and an alternate winner will be selected. All income and other applicable taxes resulting from acceptance of prize are the sole and exclusive responsibility of winner. By entering the Sweepstakes, Entrant accepts and agrees to these Official Rules and the decisions of ETAM, which shall be final in all matters. Acceptance of a prize also constitutes permission to ETAM to use winner's name, image, and likeness, and biographical information for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply. Each winner will be awarded $800 worth of gift codes corresponding approximately to a year of ETAM lingerie. The total amount will be split into 4 gift codes of $200.00 each, all 4 gift codes will be sent at once by e-mail within a week after the selection date. The gift codes will be personal. They are not transferrable to any party with or without payment of consideration. The gift codes may only be redeemed within the one year anniversary of receipt of each gift code, time being of the essence. After the one year anniversary, the gift codes will be void and of no effect. The gift codes shall be redeemable only and exclusively on the ETAM website https://us.etam.com/., according to the specified conditions. ETAM shall not be responsible in any way if the winner is unable or unwilling to select lingerie from the ETAM website for any reason including but not limited selection, material or sizing. The winners will not be allowed to exchange the prize for money or any other reward. ETAM will not be responsible if the winners do not use the gift codes in accordance with these rules. In case of force majeure, ETAM reserves the right to replace the voucher by another prize of similar type and value.

ETAM DOES NOT REPRESENT OR ALLEGE THAT $800 WILL NECESSARILY AFFORD ONE A FULL YEAR’S WORTH OF LINGERIE. THE AMOUNT OF LINGERIE ONE USES IN ANY GIVEN TIME PERIOD IS PERSONAL TO THAT INDIVIDUAL’S PREFERENCES, DESIRES AND NEEDS.

4- AUTHORIZATION

The winners shall sign a release and authorization to permit ETAM, if necessary, to use the winners, name, image, likeness and/or signature identifying them as a winner of the Sweepstakes. The release and authorization shall be in form and substance as required by ETAM. The release and authorization shall also permit ETAM to use and re-use any content posted by the Entrant’s related to ETAM or the Sweepstakes. Moreover, ETAM shall be free to mention the name of the winners on its website or Instagram account, with no other compensation than the abovementioned award. The release and authorization shall be in perpetuity (except as to Entrant’s resident in the State of Tennessee for which the authorization shall be for five (5) years.)

5- PERSONAL INFORMATION

ETAM will take all necessary steps to protect personal and/or sensitive data. ETAMS’ privacy and data protection policies may be found at https://us.etam.com/chartedeconfidentialite.html Such data will be stored and may be used by ETAM in connection with the Sweepstakes or in connection with the sale of its products. Any Entrant shall have a right to access, modify or delete his/her personal data in ETAMS’s possession. To do so, he/she can send his/her request by email to privacy@etam.com, together with a copy of his/her I.D

6- LIMITATION OF LIABILITY

By entering the Sweepstakes, Entrants waive all right to, and hold ETAM harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) arising out of or in connection with participation in the Sweepstakes or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY POSSIBLY NOT APPLY. ETAM will not be responsible for: late, incomplete, or incorrect entries; an entrant's failure to receive prize notices due to entrant's spam, junk e-mail, or other security settings or for Entrant’s' provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in the Sweepstakes; by any human error which may occur in the processing of the entries in the Sweepstakes; or any typographical, technological, or other error in the publishing of the offer, administration of the Sweepstakes, or announcement of the prizes. If, in ETAM 's opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the Sweepstakes, ETAM reserves the right in its sole discretion, to cancel or modify the Sweepstakes in a manner deemed appropriate by ETAM. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form.

7- RULES OF THE SWEEPSTAKES

By submission of an entry each Entrant accepts and agrees to abide by these Rules which will be available during the Sweepstakes period on the ETAM website and Instagram Account, via a dedicated link.

8- CHOICE OF LAW AND FORUMS

Entrant agrees that all matters arising out of or relating to the Sweepstakes and these Rules are governed by, and construed in accordance with the laws of the State of New York without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to the Sweepstakes and these Rules shall be brought exclusively in the applicable federal or state courts located in New York, New York.
