TAKE ME TO PARIS CONTEST
ORGANIZATION
ETAM LINGERIE is a limited company registered under the laws of the Republic of France, having its headquarters at 57/59 Rue Henri Barbusse, 92110 Clichy, France (hereafter “ETAM)”,
ETAM USA INC is a limited company registered under the laws of the United States, having its headquarters at 60 Broad Street, New York, NY 10004 (hereafter “ETAM)”, will conduct a Contest called “Etam Take Me to Paris” (hereafter the “Contest”). ETAM is the sole organizer and administrator of the Contest.
The Contest is neither endorsed, organized, nor administered by a third party or by Instagram. All information provided by the Entrants shall be used only by ETAM.
CONTEST OFFICIAL RULES
This Contest is not sponsored, endorsed or administered by Instagram, nor is Instagram associated with this Contest in any way. By entering, you acknowledge that Instagram bears no responsibility for this promotion and you release Instagram from any liability whatsoever in connection with this promotion. You understand that you are providing information to the Sponsor and not to Instagram. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor, and not to Instagram.
By submission of an entry each Entrant accepts and agrees to abide by these Rules which will be available during the Contest period on the ETAM website and Instagram Account, via a dedicated link.
ENTRY PERIOD
The Contest begins at 12:00 PM on June 9, 2023 and ends on June 18, 2023 at 11:59 PM (EST - Eastern Standard Time) (the ‘Entry Period’). The Contest shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein. Certain restrictions may apply.
TO ENTER
To enter the Contest, post an image on your Instagram account (the “Entry Site”) showing your lingerie, swim, or sleepwear look tagging @etam and with the hashtag #EtamTakeMeToParis. The picture would ideally show Etam products or any related products to the company’s core business (lingerie, swim, nightwear, clothing). Entrant’s profile must be public. A limit of one (1) entry via the entry site per valid e-mail address/person per day will be accepted during this Contest. All entries for the Entry Period must be received by 11:59 PM EST on June 18, 2023.
Depending on the size of your photo or entry, your connection, Internet traffic and other circumstances, your entry upload time may take several minutes to complete. Please use good taste, keep photos or entry free of obscenity or indecent material. Entries cannot defame, misrepresent or contain disparaging remarks about ETAM or any of its products, or other people, products or companies or communicate messages or images inconsistent with the positive images and/or goodwill to which ETAM associates.
Entries cannot (a) be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity; (b) promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; (c) be obscene or offensive, endorse any form of hate or hate group; (d) contain trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind other than ETAM and its products, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses; (e) contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media) without permission; (f) contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission; and (g) depict, and cannot itself, be in violation of any law.
By submitting an entry you warrant and represent that it: (a) is your original work; (b) has not been previously published; (c) has not received previous awards; (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (e) that you have obtained permission from any third party who appears in the entry or whose name, likeness, voice or other proprietary right is used in the entry, if any; and (f) that publication of the entry via various media including Web posting, will not infringe on the rights of any third party. Any such entrant will indemnify and hold harmless ETAM from any claims to the contrary. Any entrant whose entry includes photographs, likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to, depictions of persons, buildings, trademarks or logos) must be able to provide legal releases for such use including use by ETAM of such entry, in a form satisfactory to ETAM, upon request, prior to award of prize.
For a photo in which a person is recognizable, you must secure a model release from the subject or, in the case of a minor, the subject’s parent or guardian and provide it to ETAM upon request. Photos that violate or infringe upon another person’s rights, including copyright, are not eligible.
ELIGIBILITY
The eligibility requirements to participate in the Contest are as follows:
- Entrant must be over the age of 18;
- have access to the Internet;
- have a personal, valid e-mail address or telephone number; and
- be a resident of the 48 contiguous United States or District of Colombia.
NO PURCHASE IS NECESSARY TO PARTICIPATE TO THE CONTEST.
The following are excluded from participation in the Contest:
Any employee, consultant, agent or officer of ETAM Lingerie, its affiliates, agencies and subsidiaries, and members of their immediate family or persons living in the same household.
Any Entrant under the age of 21 must have prior approval from one of his/her parents or legal representative. ETAM may request proof of such prior approval.
The odds of winning will be dependent upon the number of entries received.
WINNER SELECTION
ETAM will select the best Take Me to Paris picture based on the entry’s creativity, design, execution, appropriateness, and alignment with Etam brand aesthetic.
On June 19, ETAM will select and announce one winner. The announcement will be made the following day.
The potential winner will be notified by email and will have to sign and return any required Affidavit of Eligibility and Release on ETAM Lingerie’s release and authorization form, and as required by Paragraph 4, within five (5) calendar days of the date notice is sent or such other date set by ETAM. Failure to respond within the applicable time period may result in forfeiture of prize and ETAM shall have the option to award the prize to an alternate winner. The return of any prize notification or prize as undeliverable will result in disqualification and an alternate winner will be selected. All income and other applicable taxes resulting from acceptance of prize are the sole and exclusive responsibility of winner. By entering the Contest, Entrant accepts and agrees to these Official Rules and the decisions of ETAM, which shall be final in all matters. Acceptance of a prize also constitutes permission to ETAM to use winner's name, image, and likeness, and biographical information for marketing purposes without further compensation or right of approval, unless prohibited by law. All federal and state laws apply.
PRIZE
The winner will be awarded a trip for two people to Paris, including round trip flight tickets (value up to $2,000, departing from New York Newark (EWR) or Los Angeles (LAX) or Miami (MIA) or San Francisco (SFO) in PREMIUM class) issued via our partner French Bee (plus necessary domestic flight transfer to reach the departure city) ; a one-room hotel stay for three nights up to a $750 total value (ETAM will arrange the reservation and give the related information to the winner) ; backstage accesses for the next Etam Live Show or equivalent (expected during Paris Fashion Week but whose date is to be confirmed) ; and $500 Etam shopping spree to be spent on us.etam.com or in Etam store in the USA. ETAM will let the winner know as soon as possible once the ETAM Live Show's date has been decided. Both will then arrange the travel organization according to the event's date. ETAM shall not be responsible if the event has to be cancelled or postponed. In this case, ETAM will do its best efforts to arrange for an equivalent prize. The winner will keep at his charge the meal/food/personal expenses.
The prize will be personal. It is not transferrable to any party with or without payment of consideration. ETAM shall not be responsible in any way if the winner is unable or unwilling to travel to Paris.
The winners will not be allowed to exchange the prize for money or any other reward. ETAM will not be responsible if the winners do not use $500 Etam shopping spree in accordance with these rules.
In case of force majeure, ETAM reserves the right to replace the voucher by another prize of similar type and value.
CONTENT USAGE
By entering, you acknowledge that your entry/picture/image may be posted on the ETAM Website(s) or any other media pages, in ETAM’s sole discretion. ETAM has no obligation to use or post any photo you submit. However, Entrants shall automatically grant ETAM full right and power to copy, publish, broadcast, display, distribute, use, edit, translate, alter, combine with other material, reuse and adapt any or all portions of the entries in any way and for any purpose whatsoever, until December 31, 2024, in any media now known or hereafter devised throughout the world in any manner whatsoever. Online entries that are not in accordance with these Official Rules as stated herein or are not received during the Entry Period will be ineligible.
By participating into the contest, the participants authorize Etam to share and reuse the pictures on its brand platforms they published on their social media for the contest, tagging @etam.
Moreover, ETAM shall be free to mention the name of the winner on its website or Instagram account, with no other compensation than the abovementioned award. The release and authorization shall be in perpetuity (except as to Entrant’s resident in the State of Tennessee for which the authorization shall be for five (5) years.)

No data will be collected during the contest.
LIMITATION OF LIABILITY
By entering the Contest, Entrants waive all rights to, and hold ETAM harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) arising out of or in connection with participation in the Contest or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY POSSIBLY NOT APPLY. ETAM will not be responsible for: late, incomplete, or incorrect entries; an entrant's failure to receive prize notices due to entrant's spam, junk e-mail, or other security settings or for Entrant’s' provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in the Contest; by any human error which may occur in the processing of the entries in the Contest; or any typographical, technological, or other error in the publishing of the offer, administration of the Contest, or announcement of the prizes. If, in ETAM 's opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Contest, or if technical difficulties (including viruses and bugs) compromise the integrity of the Contest, ETAM reserves the right in its sole discretion, to cancel or modify the Contest in a manner deemed appropriate by ETAM.
In the event of termination, the winner will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form.
CHOICE OF LAW AND FORUM
Entrant agrees that all matters arising out of or relating to the Contest and these Rules are governed by, and construed in accordance with the laws of the State of New York without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to the Contest and these Rules shall be brought exclusively in the applicable federal or state courts located in New York, New York.
